Promotion conditions

CONDITIONS TOPPARKEN WHEEL OF FORTUNE (Promotional Game of Chance)

These conditions apply to the "TopParken Wheel of Fortune" (hereafter referred to as "the Wheel"), which is being organized by TopParken Holding BV, with its office in Lunteren at Immenweg 15, and registered with the Chamber of Commerce under number 09147886, hereafter referred to as ‘TopParken’.

Article 1 General game conditions

  1. Every person who received a scratch card upon checking out and who is at least 18 years of age is entitled to participate in the Wheel. Permission from a legal representative is needed for participation by persons under 18 years of age.
  2. Participation in the Wheel is free of charge, with the exception of the charges for using (mobile) data.
  3. These promotional terms and conditions can be found online at topparken.nl/vakantierad/actievoorwaarden
  4. Employees of TopParken, holiday house owners at TopParken and third parties engaged by TopParken are excluded from participation.
  5. Only one prize will be granted per family living at the same address.
  6. Prizes won through the Wheel are not valid combined with other campaigns of TopParken and its partners, including discount campaigns.
  7. Only participants who participated in the Wheel in the right way and conforming to the campaign conditions and whose participation is connected to a prize are entitled to the aforementioned prize.
  8. All prizes are personal and therefore cannot be transferred. Prizes cannot be exchanged for money and in case of rejection (or due to another reason of not being issued) of a prize, will accrue to TopParken.
  9. If gambling taxes must be paid on the issued prizes, TopParken will pay these taxes.
  10. Participants of the wheel always receive a "20% Holiday Wheel discount" at TopParken.

*The discount code applies for the rental price of a booking with a stay of up to 28 nights, which is made through our website, reception, or by phone via +31 (0)88 - 500 2424. The discount is valid at all TopParken holiday parks, in all periods and for all accommodations. The discount is not valid in combination with other offers and/or discounts.

Article 2 How and when can you participate?

  1. Holidaymakers will receive a unique code when checking out, which they can use to participate in the Wheel. The unique code can be entered at the campaign page: www.topparken.nl/vakantierad. It is required to agree to the campaign conditions to participate. 
  2. One single unique code is issued per booking. 
  3. The Wheel runs from April 1st, 2024 through June 30th, 2024.

Article 3 Prizes

  1. Wheel participants have a chance to win the following prizes:
    - 1x a 49'' LG SmartTV UHD 4K, valued at €455.
    - 1x year of free coffee and tea provided by JDE valued at €605.
    - 8x two tickets to the Rijksmuseum, valued at € 40.
    - 10x Escape Tour, valued at €29.95.
    - 10x Coolblue gift card, valued at €50.
    - 4x 4 free BBQ menus, valued at €22.50.
    - 2x TopParken Holiday Cashback, valued at €449.

    Cash prizes up to €449 are tax-free. Exceeding that amount, all money prizes are taxed with 30.1% gambling tax. This will be paid by TopParken Holding B.V.
  2. Only participants who have participated in the Wheel in the correct manner and in accordance with the promotional terms and conditions during the promotion period and whose participation is associated with a prize, are entitled to that prize.
  3. The prize can be claimed until 30-9-2024. After this date, the won prize will be forfeited. Except for the Wheel of Holidays discount. 

Article 4 — Determination of the Winners

  1. The winners of the Wheel and the prizes associated with it will be determined and distributed in a random and unbiased manner. 
  2. Within 48 hours, winners will receive a personal message from TopParken via the email address provided, containing information about how to claim their prize. Participants who did not win a prize will not receive separate notification of this. 
  3. No correspondence will be accepted regarding the results of the Wheel.
  4. If a prize winner cannot be reached, or if they do not respond within three weeks to a request from TopParken about collecting the prize, they can no longer claim the prize that they won. 

Article 5 — Accountability and Indemnification 

  1. By accepting these conditions, the participant acknowledges that they participate in the Wheel entirely at their own risk.
  2. TopParken is not accountable for any damage, of any kind, resulting from or associated with participation in the Wheel. Printing, spelling, typesetting or similar errors cannot be invoked against TopParken by the participant and cannot in any way create an obligation for TopParken. TopParken is not responsible or liable for costs incurred by the participant in relation to participation in the Wheel.

Article 6 — Copyrights and Cooperation

  1. The winner who gives their cooperation to promotional activities by TopParken is not entitled to any financial compensation as a result.
  2. It is not permitted to reproduce the software, the website or the content of the Wheel, whether fully or partially in any way without written permission by TopParken.

Article 7 Personal data

  1. To participate in the Wheel, certain personal data, being email address, salutation, surname and country of origin, will be requested.
  2. Personal data will be used for assigning prizes to winners of the Wheel. For participation in the Wheel, the participant grants permission for the use of their personal data for at least one commercial mailing. An unsubscribing link will be added to this commercial mailing in case no subsequent mailings are desired.

Article 8 Rights TopParken

  1. TopParken reserves the right to terminate your participation in the Wheel at any time in case you act in conflict with these conditions or any legally applicable provision in any way without giving you any advance notification, without providing a reason, at its own discretion and without the possibility of TopParken being held accountable for this.
  2. TopParken reserves the right to terminate, interrupt or change the Wheel at its own discretion and without advance notification, and/or to change the prizes of the Wheel in case circumstances require this.
  3. TopParken will decide in any case not specified in these conditions.  

Article 9 Applicable legislation

Dutch law applies to this competition, and all disputes related to the competition which cannot be settled by means of amicable negotiation will be presented to the authorized courts in Amsterdam.

TopParken will process your question or complaint and contact you about its handling. If your complaint has not been handled to your satisfaction and you believe that the Wheel does not comply with the Code of Conduct for Promotional Games of Chance 2014, you can submit a written complaint to The Gaming Authority, PO Box 298, 2501 CG The Hague, telephone: +31 (0)70-302 1300.
